What happens when my safe deposit box agreement expires?
The short answer
When the agreement reaches its end date, you generally have three choices: renew it, renew with a different box, or empty the box and close the rental. What happens if you do none of these depends on the agreement, which may continue on set terms or treat unpaid rental under its late-payment steps. Check the renewal terms well before the end date.
Your options at the end of a rental period
- Renew on the terms Knox offers at the time, which may include updated fees.
- Change to a larger or smaller box as part of the renewal.
- Close the box: attend in person, remove the contents, return anything issued to you and settle any amounts owed.
What Knox's agreement says
The renewal and closing steps are set by Knox's agreement. After the first year the agreement renews automatically for further one-year periods, as long as you keep to its terms. Fees increase each year on 1 January in line with CPI, and promotional rates move to the current rate. If you decide not to continue, the cancellation terms explain what must happen. After the first year you can end the agreement on 30 days' written notice. When it ends you must return both keys, settle all amounts owing and remove your contents. If the contents are not collected within 30 days, Knox may have the box opened and the contents stored elsewhere, sold or otherwise dealt with to recover its costs.
If the rental lapses
A box that is not renewed but still holds items creates a problem for both sides: the provider is holding property for someone who is no longer paying, and the client risks losing access. Safe deposit agreements therefore usually set out a sequence of steps, such as reminders, formal notice, suspension of access and, as a last resort, a controlled opening in which the contents are recorded and held under the agreement's terms. The detail varies, and Knox's own process is set out in its terms. Interest at the prime rate plus 2% is charged on late rental. If an amount remains unpaid 14 days after written notice, Knox may suspend access and exercise its lien over the contents, which can include opening the box and selling contents to recover the debt, with any surplus paid to you within 20 business days. Unpaid accounts may also be listed with the credit bureau.
Consumer protection and your circumstances
South African consumer law, including the Consumer Protection Act, contains rules about fixed-term consumer agreements, including how they end and how they may continue. Whether and how those rules apply depends on the agreement and on who the customer is. If a box holder has died or lost capacity, the estate or a legally appointed representative deals with the box rather than the original holder.
What to do before the end date
Diarise the end date, keep your contact details current so reminders reach you, and decide early whether to renew. If you plan to close the box, book a time to empty it and arrange how you will take the contents to their next location.
